How to Enter

Information on how to enter, mechanics of entry and Prize (defined below) form part of these Terms and Conditions. Entry into this promotion constitutes acceptance of these Terms and Conditions. It is important that you read and understand these Terms and Conditions.

The promotion will be conducted via the Promoter's website at www.subaru.com.au/ultimate-subaru-wilderness-adventure-competition.

Entry is only open to residents of Australia aged 25 years or over who can travel to Perisher Valley Hotel in NSW, St Falls Resort in VIC or Subaru Alpine Retreat at Hotham in VIC between 9th–15th August 2027 (inclusive).

Entries into the promotion will open at 9.00am (AEST) on Monday 22nd June 2026 and close at 11:59pm (AEDT) on Monday 5th October 2026 ("Promotional Period").

To enter, you must, during the Promotional Period:

Go to www.subaru.com.au/ultimate-subaru-wilderness-adventure-competition, enter your contact details (full name, gender, email address, contact number and postcode), and submit the fully completed entry form.

Only one (1) entry is permitted per person.

Winner(s) Draw and Prizes

The draw will take place at Anisimoff Legal, L3/162 Collins Street, Melbourne, VIC 3000 on Tuesday 6 October 2026 at 11:00am (AEDT) in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing via email within two (2) business days of the draw and winners' details (first initial, surname and postcode) will be published online at www.subaru.com.au/ultimate-subaru-wilderness-adventure-competition from Tuesday 13 October 2026.

The Prizes will be allocated as follows:

the first valid entry drawn will win their choice of either Prize Option 1, Prize Option 2 or Prize Option 3 (as defined herein);
the second valid entry drawn will win their choice of the remaining two prize options; and
the third valid entry drawn will win the remaining prize option.

The first drawn winner must notify the Promoter of their selected prize option no later than Friday 9 October 2026 and the second drawn winner must notify the Promoter of their selected prize option no later than Wednesday 14th October 2026.

Prizes

Prize Option 1

Prize Option 1 is a trip for two (2) people to the Subaru Alpine Retreat at Hotham in Victoria, valued at up to $32,468 depending on date of travel. Prize Option 1 includes:

One (1) night accommodation for two (2) people at Hotham Igloo Village (valued up to $924);
Two (2) nights accommodation at a Hotham Chalet for two (2) people (valued up to $2,400);
Resort entry for one (1) vehicle (valued up to $276);
Two (2) day lift tickets, lessons (adult) and rental (adult) for two (2) adults valued up to $2,368;
A Subaru loan vehicle (Subaru Outback Wilderness AWD Apex), with chains and Thule accessories included, to keep for twelve (12) months. The Subaru loan vehicle is to be picked up from Albury Subaru to drive to the snow and take home for the time remaining of the twelve (12) month loan period. The prize winner will attend a vehicle briefing and handover at the time of picking up the Subaru loan vehicle. The Subaru loan vehicle is to be returned to the winner's closest Subaru dealership no later than COB Wednesday, 9th August 2028. Loan of Subaru vehicle is valued at up to $17,000;
$3,000 Helly Hansen online gift voucher for the winner only;
$3,000 Salomon online gift voucher for the winner only;
$1,000 Thule online gift voucher for the winner only;
$2,000 Visa card for the winner only; and
$500 Subaru online merchandise voucher to be used on Wilderness merchandise.

Accommodation, resort entry, lift tickets, rental and ski lesson components of Prize Option 1 must be taken between 9th to 15th August 2027 (inclusive).

Prize Option 2

Prize Option 2 is a trip for two (2) adults and two (2) children to Perisher Valley Hotel in New South Wales, valued at up to $17,897 depending on date of departure. Prize Option 2 includes:

Two (2) nights accommodation for two (2) adults and two (2) children at Perisher Valley Hotel (valued at up to $2,500);
Subaru Priority Parking for three (3) days (no monetary value);
National Park entry for one (1) vehicle (valued up to $87);
Night Skiing experience for two (2) adults and two (2) children (valued up to $436);
Two (2) day lift tickets for two (2) adults and two (2) children, one (1) lesson per person for two (2) adults and two (2) children and two (2) days rental gear for two (2) adults and two (2) children valued up to $5,774;
A Subaru loan vehicle (Subaru Outback Wilderness AWD Apex), with Thule accessories included, to borrow for the duration of the trip. The Subaru loan vehicle is to be picked up from Canberra Subaru to drive to the snow. The loan vehicle must be returned to Canberra Subaru at the conclusion of the trip. Loan of Subaru vehicle valued at up to $600;
$3,000 Roxy online gift voucher for the winner only;
$3,000 Quiksilver online gift voucher for the winner only;
$1,000 Thule online gift voucher for the winner only;
$1,000 Mountain Money to spend at participating food and beverage and retail outlets at Perisher for the winner only; and
Wilderness branded merchandise pack including XXXX for the winner only (valued at $500).

Accommodation, priority parking, national park entry, night skiing experience, lift tickets, rental and ski lesson components of Prize Option 2 must be taken between 9th to 15th August 2027 (inclusive).

Prize Option 3

Prize Option 3 is a trip for two (2) adults to St Falls Resort in Victoria, valued at up to $10,224, depending on date of departure. Prize Option 3 includes:

Two (2) nights accommodation for two (2) adults at St Falls (valued at $2,600);
Resort entry for one (1) vehicle (valued up to $276);
Subaru Priority Parking (no monetary value);
Back Country skills day for two (2) adults (valued up to $880);
Two (2) day lift tickets for two (2) adults, one (1) lesson per person for two (2) adults and two (2) days rental gear for two (2) adults valued up to $1,368;
A Subaru loan vehicle (Subaru Outback Wilderness AWD Apex), with chains and Thule accessories included, to borrow for the duration of the trip. Accommodation, resort entry, priority parking, back country skills, lift tickets, rental and ski lessons components of Prize Option 3 must be taken between 9th to 15th August 2027 (inclusive).

Total prize pool value is up to AU$60,589. The Promoter accepts no responsibility for any variation in the Prize value.

Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

Supply of the Prizes is subject to the following terms and conditions:

Stay at allocated prize accommodation of Perisher Valley Hotel, St Falls Resort at Falls Creek, the Hotham Alpine Nature Experience and Subaru Alpine Retreat at Hotham must be taken between 9th to 15th August 2027 (inclusive) and is subject to booking availability. If a winner cannot take the Prize on these dates, the Prize will be forfeited.
Hotel stay, lift passes, and snow gear hire elements of the Prize are subject to the terms and conditions of the relevant supplier, which will be made known to winners prior to, or at the time of, redemption.
Itinerary to be determined by the Promoter in its absolute discretion.
The winners may be required to present their credit card at time of accommodation check-in.
Any ancillary costs associated with redeeming the vouchers are not included. Any unused balance of the vouchers will not be awarded as cash. Redemption of the vouchers is subject to any terms and conditions of the issuer, including those specified on the vouchers.
Winners will be responsible for any costs associated with redemption of the Prizes. For the avoidance of doubt, flights to and from the prize destinations are not included and must be arranged and paid for by the winner(s), if required. All travel, accommodation (unless expressly stated), transfers, meals, insurance and all other ancillary costs are not included in the Prize and are the responsibility of the winners. Spending money, items of a personal nature and in-room charges are not included.
For the avoidance of doubt, the Promoter is not responsible for any item, service, cost, claim or matter not expressly stated to be included in a Prize, howsoever the same may arise.
The Prizes must be taken as offered and cannot be varied, unless otherwise stated. The Promoter accepts no responsibility for any taxation implications which may arise from the redemption of a Prize. If a Prize or any component of a Prize becomes unavailable, for any reason beyond the Promoter's reasonable control, then a similar prize or element of a prize of equivalent value and/or specification will be awarded in lieu, subject to any written directions from a regulatory authority.
All components of the Prizes must be taken together or otherwise are deemed to be forfeited.
Travel is subject to any government issued travel restrictions (e.g. border closures), booking availability, and blackout periods may apply.
If a winner and/or their nominated companion is unable to travel in accordance with the restrictions above for any reason whatsoever, the winner shall be deemed to have forfeited the Prize and an alternative winner may be chosen. If for any reason a winner does not claim or travel as part of the Prize due to health or personal reasons, the Promoter has the right to select another winner subject to directions from a regulatory authority.

Supply of the Subaru loan vehicle element of the Prizes is subject to the following terms and conditions. The loan and use of the loan car element of the Prizes is subject to booking and availability and the Promoter's standard loan vehicle terms and conditions in relation to test drives and similar arrangements apply. Subject to the Promoter being satisfied that a winner is legally entitled to operate the loan car, that winner will be covered by the Promoter's insurance policy over the loan car. It is a condition of accepting the Prize that the winners (and their companion/s) must sign any legal documents as and in the form the Promoter and/or Prize supplier(s) in their absolute discretion may require prior to accepting the Prize, including but not limited to a legal release and indemnity form. The winner must be 25 years of age or older at the time of taking the Prize and must have a full, current and unrestricted State or Territory driver's licence (which is not under suspension or cancellation) as at the date on which a winner is to drive the vehicle, and for the duration of the loan car term. Any traffic infringements, petrol costs, toll fees and similar costs incurred while driving the vehicle are the responsibility of the winners. The winners acknowledge and agree that the Promoter will nominate the winner as the responsible driver for any fine, toll or any other similar imposts received pertaining to the period during which the winner is in possession of the Subaru vehicle, and the winner will cooperate with the Promoter to allow it to do so (including, without limitation, providing the Promoter with any necessary information). The winners will be responsible for any insurance excess payable because of damage to the vehicle while in the possession of the winners. Unless expressly stated in these Terms and Conditions, all other expenses (including travel to and from the dealership, additional fuel and any tolls incurred, etc.) become the responsibility of the winners. The winners acknowledge that they will not become entitled to any security interest in the vehicle because of winning the Prize.

Subject to the unclaimed Prize draw clause, if for any reason a winner does not take the Prize (or an element of the Prize) at/by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.

Winners must claim the Prize from the Promoter by Wednesday 28th October 2026 at 11.59pm AEDT. If the Prize is not claimed by this date, that winning entry will be deemed invalid and an unclaimed Prize draw may take place with the pool of remaining entries, at the same time and place as the original draw, on Thursday 29th October 2026, in the presence of an independent scrutineer. The new winner(s), if any, will be notified within two (2) days of the draw via email, and their details (first initial, surname and postcode) will be published on www.subaru.com.au/ultimate-subaru-wilderness-adventure-competition from Thursday 5th November 2026. Winner(s) of the unclaimed prize draw (if any) must claim their Prize by Thursday 12th November 2026.

The winners and/or his or her companion(s) must conduct themselves in a polite and respectful manner while participating in any element of the Prize and must not behave in any way which might bring disrepute to the Promoter, its activities or products. If the Promoter considers that a winner or his or her companion(s) are engaging in unacceptable conduct, the Promoter may, in its absolute discretion, require that the winner and his or her companion(s) leave the venue which is the subject of an element of the Prize.

The winners of the skiing prize ("Activity") and his/her companion(s) acknowledge that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. The winners and their companion(s) must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or their companion(s) from participating in the Activity if, at any time, they reasonably believe that the winner or their companion(s) pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

Eligibility of Entrants and Entries

The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies who are directly associated with the conduct of the promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

Entrants must have a valid email address at the time of entering the promotion and, by entering the promotion, entrants agree to receiving marketing communications from the Promoter.

You may only enter in your own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion. Any entry of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right, at any time, to verify the validity of any entry and entrants (including an entrant's identity, age and place of residence) and to request that you produce (within the requested time) appropriate photo identification or other documentation in order to confirm your identity, age, place of residence, eligibility to enter and claim a Prize, and any other information submitted by you in entering the promotion, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or you or your entry have not been verified to the Promoter's satisfaction, then your entry will be ineligible and deemed invalid. A Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter reserves the right to request proof of residency at the stated address and identification for verification (to the Promoter's satisfaction in its discretion) before issuing a Prize. All of the Promoter's decisions are final and no correspondence will be entered into.

Entries will be deemed accepted and final at the time of receipt by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Any entry that contains content that the Promoter (in its absolute discretion) considers to be incomplete, inaccurate, erroneous, incomprehensible, offensive, objectionable or inappropriate in any way will be deemed invalid.

The Promoter reserves the right to disqualify you for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Terms and Conditions; or (c) if you are engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from you are reserved.

In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify the Prizes, subject to any written directions from a relevant regulatory authority.

Liability, Indemnities and Warranties

Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

Subject to regulatory authority requirements, the Promoter may, to the fullest extent permitted by law, cancel, modify, suspend or delay the promotion at any time if something happens that is beyond its reasonable control, including for any technical or operational reason, unauthorised intervention or fraud, or by reason of anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion.

Nothing in these Terms and Conditions purports to limit, exclude or modify the non-excludable statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 or similar consumer protection law in the states and territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury, or loss or damage, direct or indirect, arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions (whether or not under the Promoter's control), delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv) acceptance, redemption, participation in and/or use of any element of a Prize; (v) personal injury or death; and/or (vi) property damage; and (vii) any tax liability incurred by a winner or entrant.

As a condition of entering this promotion, in the event you are a winner, you consent to the Promoter using your entry (including your photograph), name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation, for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. You also agree that, in the event you are a winner, you will participate in all reasonable promotional activities in relation to the promotion as requested by the Promoter and its agents.

By entering the promotion, you consent to the use of your personal information by the Promoter and Sponsors, as set out in this clause and the Promoter's Privacy Policy. The Promoter may collect and use personal information submitted by you for the purpose of conducting the promotion and to send you marketing communications, and to enable the Promoter and the sponsors to send you marketing communications. If the personal information requested is not provided, you cannot participate in the promotion and are deemed ineligible. Personal information may be provided to third party organisations, including but not limited to agents, contractors and service providers of the Promoter, each of the Sponsors, and if required, may be provided to Australian regulatory authorities. You can stop this information being used for this purpose by contacting the Promoter. All personal information will be stored on the information technology platforms of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected can be found at https://www.subaru.com.au/privacy-policy. A copy of the Privacy Policy of each of the Sponsors may be viewed at each of their respective websites. If the Promoter or the Sponsors send you marketing communications, they will always give you the opportunity to opt out from receiving any further marketing communications from them. To request access, update or correct information, or for any other privacy related questions, please contact the Promoter's Privacy Officer via email at privacy.officer@subaru.com.au. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter's Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion, entrants consent to the overseas transfer of personal information on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.

Any provision (or part thereof) of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. This does not invalidate the remaining provisions (or parts thereof) of these Terms and Conditions nor affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction.

The Competition is being run by the Promoter, during the Competition Period (as defined below).
By entering and/or participating in the competition, you ("You") agree to these Terms and Conditions.
By submitting an Entry, You consent to being added to the Promoter's marketing and promotional mailing list (and, if applicable, the Partner's marketing and promotional mailing list).

Winner Process	One (1) potential winner will be drawn via a random electronic draw at 5 Billabong Place, Burleigh Waters QLD, Australia 4220 on the Prize Draw Date, and the Prize will be awarded to the first person drawn following winner validation and verification ("Winner"). The Promoter may draw additional reserve entries in the draw and record them in order, in case the winning Entry/Entrant is deemed invalid or the prize is unclaimed ("Reserve Winners").
Winner Notification	The Winner will be notified via email within two (2) business days of the Prize Draw Date. The name of the Winner will be announced on the Promoter's website within three (3) business days of the draw date and will remain available for a period of thirty (30) days.

Additional Prize Conditions

The Prize and all elements of the Prize must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable.
The Prize is subject to any additional terms and conditions imposed by the Promoter, as reasonably required, including conditions related to the claiming of the Prize.
The Winner(s) are responsible for all other unspecified costs related to the Prize (for instance, any insurance, etc).
The Prize is not transferable or exchangeable nor can it be redeemed for cash.
If the Prize or any element of the Prize becomes unavailable for any reason beyond the Promoter's control, then a similar prize of equal or greater value will be awarded to the Winner in lieu, subject to the approval of the relevant regulatory authorities (if required). Without limiting the foregoing, the Promoter may, at its absolute discretion, substitute cash for the Prize or any component of the Prize (the amount of cash being equal to the Prize, or component of the Prize, value specified in these Terms and Conditions).
All Prize advertisements depicting or describing the prizes and trademark references are illustrative rather than depictive and do not imply an association with the Promoter.
The Prize stay must be taken from Wednesday to Wednesday only. No alternative arrival or departure days will be permitted.
The Prize must be redeemed for travel between November 2026 and March 2027, subject to availability and any blackout dates determined by the Promoter or Prize Supplier.
Alcohol is not included as part of the Prize and any alcohol consumed during the stay will be at the Winner's own expense.
The Winner and travel companion must obtain and maintain comprehensive travel insurance, including medical evacuation (medevac) coverage, for the duration of the trip. Proof of such insurance may be required prior to travel. Failure to obtain suitable insurance may result in forfeiture of the Prize.
Entry is open to residents of Australia aged 18 years or over, excluding residents of South Australia and the Australian Capital Territory.

Unclaimed Prize

All reasonable efforts will be taken to contact the Winner, however the Promoter takes no responsibility for unread, undelivered or incorrectly provided email information.
If the Prize has not been accepted or claimed, or if, after making all reasonable attempts, the Winner cannot be contacted and the Prize remains unclaimed within one (1) month from the Prize Draw Date, the Winner will be deemed to have forfeited the Prize and will have no further claim. The Promoter will either award the Prize to a Reserve Winner or conduct an unclaimed prize draw at the same time and location as the original draw, one (1) week after the Prize is deemed forfeited ("Unclaimed Prize Draw").
Any new Winner from the unclaimed prize process will be notified by email within one (1) business day of the Unclaimed Prize Draw and will have their name published on the Promoter's website for a period of thirty (30) days from the date of notification.
An unclaimed prize draw will take place at 10:00am AEST on 10/07/2026 at 5 Billabong Place, Burleigh Waters QLD, Australia.
This process will continue, with the same timeframes, until a Winner is successfully contacted and accepts the Prize.

Releases

To the extent permitted by law, by entering this Competition, you agree to release, discharge, indemnify, and hold harmless the Promoter and any Partner (if any), and their respective directors, officers, employees, agents, contractors, and affiliates (collectively, the "Released Parties") from any claims, actions, losses, damages, liabilities, costs, or expenses of any kind (including, without limitation, legal costs and expenses on a full indemnity basis) arising out of, or in any way connected with, your participation in this Competition or any Competition-related activities (including, without limitation, attendance at events, travel, or other activities) and the acceptance, use, misuse, or possession of any prize awarded hereunder. This includes, without limitation, any claims arising from: (i) non-compliance by you with these Terms and Conditions; (ii) any malfunction, technical failure, error, delay, or other problem arising in connection with the collection, processing, storage, or retention of entry information; (iii) any typographical or other error in the administration of the Competition or announcement of any winner; (iv) any act or omission of the Released Parties, whether negligent or otherwise; and (v) any personal injury, property loss or damage, or death arising in connection with your participation in the Competition or acceptance or use of any Prize.
Nothing in these Terms and Conditions excludes, restricts, or modifies any rights that you may have under the Australian Consumer Law (ACL) or other applicable consumer protection legislation that cannot be excluded, restricted, or modified by agreement. However, to the fullest extent permissible by law, the Promoter and the Released Parties will not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, revenue, goodwill, or opportunity, arising out of or in connection with your participation in the Competition or use or misuse of any Prize, even if the Promoter was advised of the possibility of such damages.
As a condition of accepting the Prize, the Winner may be required to sign a legal document, in a form determined by the Promoter at its sole discretion, which may include a release and indemnity. Failure to sign any such document will result in the Winner's entry being deemed invalid, and they will forfeit any entitlement to the Prize.

Conditions

Entrants consent to the use of their names, likeness or image by the Promoter if they are the winner of the Prize for an unlimited period of time without remuneration. Entrants agree to comply with any reasonable direction of the Promoter in this regard.
If, for any reason, this competition cannot run as planned due to events such as war, terrorism, state of emergency, natural disaster, pandemic, computer virus, telephone network failure, unauthorised tampering, fraud, technical failures, or any other cause beyond the Promoter's control, the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the competition, or invalidate any affected entries. This is subject to the approval of relevant authorities, if required. The Promoter will not be liable for any failure or delay in performing its obligations under these Terms and Conditions due to any act, omission, event, or circumstance beyond its reasonable control.
The Promoter reserves the right, at any time, to verify the validity of Entrants (including an Entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.
Any entries or nominations that are deemed by the Promoter, in its sole discretion, to be rude, defamatory, offensive, illegal, incomprehensible, incorrect, incomplete, or that breach any law or infringe on third-party rights, including intellectual property rights, will be invalid and may be removed by the Promoter.
The Promoter does not knowingly collect personally identifiable information from persons under the age of eighteen (18) years old. Such persons are expressly prohibited from submitting their personally identifiable information to the Promoter and any information submitted by such users will not knowingly be used, posted, or retained by the Promoter.
The Promoter reserves the right to cancel or amend the Competition and these Terms and Conditions if necessary, for reasons outside of its control or as required by law. Any such changes will be communicated to entrants as soon as reasonably possible. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
By entering this Competition, Entrants explicitly consent to the storage and use of their personal information by the Promoter, its related bodies corporate, and, where applicable, the Partner, for future promotional and marketing purposes. This includes contacting Entrants via the contact details provided (e.g., email, phone, SMS, or other forms of communication). Entrants also consent to being added to the marketing and promotional mailing lists of both the Promoter and, if applicable, the Partner.
If you are a Winner, the Promoter will use your personal information to conduct and manage the Competition. The Promoter may disclose your personal information to its related bodies corporate or the Partner to assist in administering the Competition, communicating with you, or storing data. Your personal information will be handled in accordance with the Promoter's and, if applicable, the Partner's, Privacy Policy(ies).
Without limiting the foregoing, Entrants' personal information provided in connection with this Competition will be handled in accordance with the Privacy Policy (or Privacy Policies, if a Partner is involved in the Competition) and the Privacy Act 1988.
The laws of Queensland, Australia apply to these Terms and Conditions and the parties submit to the exclusive jurisdiction of the courts of Queensland, Australia.
This Competition is in no way sponsored, endorsed or administered by, or associated with, any social media platform, including, but not limited to, Facebook, TikTok, Instagram and Twitter. Entrants provide their information to the Promoter and not to any social media platform. Entrants completely release any relevant social media platforms from any and all liability.
